Land
Information Memorandums (LIMs)
A Land Information
Memorandum (LIM) is a
report about a particular property. At your
request, it is prepared from records held by the Council only, and
provides:

Information identifying each (if any) special feature or
characteristic of the land concerned, including (but not limited to)
potential erosion, avulsion, falling debris, subsidence, slippage,
alluvion or inundation, or likely presence of hazardous contaminants,
that:

is known
to the Council; but
-
Is not
apparent from the district scheme under the Town and Country Planning
Act 1977 or a district plan under the Resource Management Act 1991.

Information on private and public stormwater and sewerage drains as
shown in the Council’s records.

Information relating to the Rateable Valuation of the property and any
rates owing.
-
Information concerning any consent, certificate, notice, order, or
requisition affecting the land or any building on the land previously
issued by the Council (whether under the Building Act 1991 or any
other Act).

Information concerning any certificate issued by a building certifier
pursuant to the Building Act 1991.
-
Information relating to the use to which that land may be put and
conditions attached to that use (including zoning information).
-
Information which has been notified to the Council by any statutory
organisation with the power to classify land or buildings for any
purpose.
-
Any
information which has been notified to the Council by any network
utility operator pursuant to the Building Act 1991.
The Land
Information Memorandum may also include other information concerning the
land which the Council considers relevant and believes it is appropriate
to make available. As information provided in a LIM is limited to that
which is known to the Council with respect to the above matters, you are
urged to also undertake your own investigations. Please note the Council
does not visit or inspect the land or any buildings on it as part of its
response to a LIM request.
The LIM may also
include other information concerning the land which the Council at its’
discretion, considers relevant.

Why should I get a LIM?
If you are considering purchasing
a property, it is recommended that you obtain a LIM as it may provide
important information about the property and any associated buildings.
If you are selling a property, a
LIM can help inform potential buyers of the existing status of the
property.
If you are a professional helping
property buyers and sellers, clients may expect you to be aware of the
information contained in a LIM when giving your advice.
If you are insuring a property,
or lending on it as security, a LIM may inform you about its status
and risks in relation to it.

How
much does a LIM cost?
Papakura District Council has two LIMs
processing streams - Standard and Urgent.
Urgent
applications attract a higher fee than non-urgent. Payment may be made
in cash, by cheque or EFTPOS. For information on the fee

Where do I submit my completed application form?
You can submit your
LIM application by posting or delivering it to our Customer Services
Centre, located at 35 Coles Crescent, Papakura. Monday to Friday between
the hours of 8:00am and 4:30pm. We do not accept LIM applications by
fax.

When
will I receive my LIM?
Providing
all the necessary information is supplied with your application, the LIM
will be provided by the Council within 10 working days for a Standard
LIM or 2 days for an Urgent LIM.
When filling
in your application form you should indicate in the space provided how
you would prefer to receive the LIM. A completed LIM may be collected
from the Council office, posted, e-mailed or faxed to you as soon as it
is completed. If e-mailed or faxed, only the LIM document will be
forwarded at this time, and the original and attachments will be mailed.
If you wish to collect the LIM, the Council will telephone you to advise
that the LIM has been completed and is ready for collection.
